2. Service Overview

ClearPathStudio offers upscale yacht charter services, including but not limited to:

  • Daily yacht rentals
  • Sunset cruises
  • Corporate retreats
  • Private events
  • Multi-day charters

All services are subject to availability and climatic conditions. We retain the right to alter or cease services at any given time.

3. Booking and Reservations

3.1 Booking Process

To secure a charter, you must:

  • Be at least 18 years old
  • Supply accurate and complete details
  • Make payment for the necessary deposit as indicated in your booking confirmation
  • Consent to these Terms & Conditions

3.2 Confirmation

Bookings are only deemed confirmed once payment is made and written confirmation from us is received. We have the authority to deny service to anyone for any reason at our discretion.

3.3 Availability

Charters are contingent on vessel availability and favorable weather conditions. Reasonable attempts will be made to accommodate your chosen dates and hours.

4. Payment Terms

4.1 Pricing

Pricing is stated in € and includes applicable taxes unless specified otherwise. Prices are subject to change without prior notification.

4.2 Payment Schedule

  • Deposit: A requirement of 50% of the total charter cost is due at the time of booking
  • Remaining Balance: Payable 48 hours before the charter's departure
  • Additional fees (if applicable): Payable upon completion of the charter

4.3 Payment Methods

We accept major credit cards, bank transfers, and certified cheques. Secure, encrypted systems are used for processing payments.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • More than 72 hours prior to departure: Complete refund minus transaction fees
  • 24-72 hours before departure: Refund of 50%
  • Within 24 hours of departure: No refund provided

5.2 Weather Cancellations

If unsafe weather conditions are determined by our captain, we will propose to:

  • Reschedule the charter with no additional costs to the next available date
  • Issue a full refund if rescheduling is impractical

5.3 Mechanical Issues

If the assigned vessel encounters mechanical issues, we will try to provide an appropriate replacement. If no replacement is available, a full refund will be extended.

6. Safety and Conduct

6.1 Safety Requirements

All guests must:

  • Adhere to all instructions from the crew
  • Utilize safety equipment when instructed
  • Inform us of any medical conditions that may impact your safety
  • Stay within specified areas aboard the vessel

6.2 Prohibited Items

The following items are not permitted aboard:

  • Glass containers
  • Illegal substances
  • Firearms or weapons
  • Excessive non-alcoholic drinks beyond reasonable personal use
  • Pets (unless consent has been given prior)

6.3 Conduct

Passengers must behave respectfully at all times. We reserve the right to terminate a charter without a refund if passenger behavior is deemed a safety risk or interferes with others' enjoyment.

7. Liability and Insurance

7.1 Our Liability

We're only liable for up to the cost of your charter. We are not responsible for:

  • Injuries caused by passenger negligence
  • Theft or damage to personal belongings
  • Indirect, consequential, or penal damages
  • Delays due to weather or events beyond our control

7.2 Insurance Coverage

We have full marine insurance that covers our vessels and operations. Charterers are accountable for their own travel and personal insurance.

7.3 Assumption of Risk

By choosing to participate in our charter services, you recognize the intrinsic risks involved with marine activities and you accept responsibility for your safety and welfare.

8. Modifications and Itinerary Changes

We have the right to adjust itineraries, courses, or timetables based on weather conditions, safety requirements or operational needs. We will strive to provide similar alternatives where possible.

9. Force Majeure

We are not responsible for delays, cancellations, or alterations resulting from forces outside our control, which may include, but are not limited to:

  • Extreme weather conditions
  • Natural calamities
  • Regulatory edicts
  • Port closures
  • Technical failures

10. Privacy and Data Protection

Your private data will be managed in compliance with our Privacy Policy. Utilizing our services signifies your consent to the use and collection of your data as provided in our Privacy Policy.

11. Intellectual Property
